Welcome to Pixium Technologies WLL. These Terms of Use (“Agreement”) govern your access to and use of our software, products, and services (“Software and Services”). By using Pixium Technologies WLL’s Software and Services, you agree to comply with and be bound by these terms. If you do not agree, please do not use our Software and Services.

1. Acceptance of Terms

By using our Software and Services, you confirm that you have read, understood, and agree to these Terms of Use and any related policies we provide.

2. Use of Software and Services

You agree to use our Software and Services only as permitted by this Agreement, applicable laws, and regulations. You must not misuse our Software or Services, including but not limited to unauthorized access, copying, distribution, or any activity that interferes with the proper functioning of the Software.

3. Termination and Breach of Contract

Pixium Technologies WLL reserves the right to determine if your behavior violates any laws or this Agreement. If you breach any terms, Pixium Technologies WLL may delete violating content, restrict, suspend, or terminate your access to the Software and Services immediately without prior notice. You will be held responsible for any violations.

Upon termination, you must immediately stop using the Software and Services and delete all copies and related materials installed on your devices.

4. Indemnification

You agree to indemnify, defend, and hold harmless Pixium Technologies WLL, its affiliates, officers, directors, employees, agents, and any third parties acting on its behalf from and against any claims, liabilities, losses, damages, costs, or expenses (including reasonable attorney fees) arising from:

Your misuse of our Software or Services,
Any breach of this Agreement by you or anyone using your account,
Any violation of laws or third-party rights by you or anyone using your account.

5. Disclaimers

5.1 No Warranty

Our Software and Services are provided “as is” and “as available,” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or reliability.

5.2 Software Safety and Performance

Pixium Technologies WLL does not include malicious code and strives to maintain safe and reliable operation. However, due to technical limitations, compatibility or performance issues may occur. We make no guarantees of uninterrupted or error-free service.

If you experience problems, please contact our technical support. If issues cannot be resolved, you may uninstall the Software. Pixium Technologies WLL is not liable for losses arising from software malfunctions or incompatibilities to the extent permitted by law.

6. Limitation of Liability

To the fullest extent allowed by law, Pixium Technologies WLL and its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption, arising from:

Your use or inability to use the Software and Services,
Unauthorized access or alteration of your data,
Deletion or corruption of your data,
Statements or conduct of third parties on our Services,
Any other issues related to the Software and Services.

Some jurisdictions do not allow limitations on liability for personal injury or certain damages, so some limitations may not apply to you.

Pixium Technologies WLL’s maximum liability for any claim will not exceed the amount you paid for the relevant product or service in the 12 months prior to the claim.

7. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of Qatar, excluding its conflict-of-law principles.

Any dispute arising out of or relating to this Agreement shall first be attempted to be resolved by amicable negotiation. If negotiation fails, disputes shall be submitted to arbitration under the Qatar International Center for Conciliation and Arbitration (QICCA) rules, conducted in Doha, Qatar. The arbitration proceedings shall be conducted in English, and the arbitration award shall be final and binding.

You agree to resolve disputes individually and waive the right to participate in any class or representative actions.

8. General Provisions

Headings: Section headings are for convenience only and do not affect interpretation.
Severability: If any term is found invalid or unenforceable, the remaining terms remain in effect.
Language: If these terms are provided in multiple languages, the English version prevails in case of discrepancies.
No Waiver: Pixium Technologies WLL’s failure to enforce any term shall not waive its right to enforce it later.
Entire Agreement: This Agreement, along with any related policies, constitutes the entire agreement between you and Pixium Technologies WLL regarding your use of the Software and Services and supersedes all prior agreements.
